1. Introduction

These terms apply to the use of this website and to every order you place with us, whether through the order request form, by email or through any other channel. By using the website or sending an order request you accept these terms and our Privacy policy and Cookie policy.

2. Who we are

We are an intermediary platform for auto parts from the USA: we find and purchase genuine OEM parts and accessories from suppliers in the USA on behalf of our customers, and organise their transport to Europe. Parts are purchased for you only after you have accepted our quote and paid for the order.

3. Using the website

• You must be at least 18 years old and able to enter into a binding contract.
• The details you give us (name, email, delivery address, phone) must be true and complete, so that we can contact you and deliver the order.
• Fake, fraudulent or abusive requests are not allowed. We may refuse or cancel such requests and, where required, inform the competent authorities.

4. How an order works

1. Order request. You add parts to the cart and send an order request. This is not yet a purchase and nothing is paid on the website.
2. Quote. We check availability and reply by email within 1 business day with a quote: the final price of the parts, the shipping costs and the estimated delivery time. A quote is valid for 3 days unless it states otherwise, because supplier prices and exchange rates change.
3. Acceptance and payment. The contract is concluded when you accept the quote and pay the full amount within its validity. We may decline a request, for example when a part is unavailable or no longer supplied.
4. Placing the order. After we receive the payment we purchase the parts on your behalf from our suppliers in the USA. They are shipped to our warehouse in Romania and from there to your address.

5. Prices, VAT and customs

• Prices are shown in euro (EUR). Prices on the website are indicative; the binding price is the one in our quote.
• For private individuals, the prices of the parts include VAT and customs duties. You do not pay further import charges on delivery.
• Shipping is added separately: international shipping (USA → Europe) is calculated on the billed weight of the whole order (at least 1 kg per order), and the local courier to your address depends on the destination country and the weight.
• Business customers tick the business option at checkout and give their company name and VAT number. We then confirm the price and invoice details in the quote.

6. Payment

You pay the full amount of the quote in EUR by bank transfer, using the details in our email. We order the parts only after the payment has reached our account. If the payment does not arrive within the validity of the quote, the quote expires and we may send you an updated one.

7. Weight and dimensions

Shipping costs are calculated from the weight in the manufacturer’s catalog. When the parts reach our warehouse they are weighed and measured again. If the real weight or the size of the parcel is significantly higher than the catalog data (for example oversized parts such as bumpers or body panels), we tell you before shipping it to you: you can pay the difference or cancel and receive a refund of the amount paid for the parts that have not yet been delivered, minus costs already incurred that we show you. If the real weight is lower, we keep the price of the quote.

8. Delivery

• Estimated delivery: 2–3 weeks after we confirm and place your order. Delivery times are estimates; some parts come from the manufacturer’s warehouse or are produced on demand and take longer. We keep you informed by email.
• Parcels are delivered by courier to your address (home delivery). We send you the tracking number when the parcel leaves our warehouse.
• Please check the parcel when you receive it and tell us within 3 days if it is damaged or the content does not match the order (photos help). See Returns & warranty.
• The risk of loss or damage passes to you when you (or a person you designate) receive the parcel.

9. Fitment and product information

Part numbers, descriptions and vehicle compatibility come from the manufacturer’s catalog; photos may be illustrative. Please check that the part fits your vehicle before you accept the quote. Your VIN helps us identify the right part, but we cannot guarantee fitment for modified vehicles or for vehicles built for a different market. Superseded part numbers may be replaced by the newer number that the manufacturer supplies.

10. Cancelling an order

You can cancel free of charge before you pay. After payment, and before we have placed the order with our supplier, you can cancel by email and we refund the full amount. Once the parts have been purchased from the supplier, the order can no longer be cancelled; the returns policy below applies after delivery.

11. Returns

Parts are purchased specially for each order, so parts that arrived correctly (the part number you ordered, or the newer number that officially replaces it, in good condition) are not returnable — also if you changed your mind or the part does not fit your vehicle. Please check the part number and fitment before you accept the quote.

We take back only parts that arrived damaged or that are not the part you ordered. Tell us within 3 days of delivery, with photos; after our confirmation you send the part back, at your cost, to our warehouse in Romania (71 Sf. Ilie, Vișan, Iași 707041, Romania), and we send you the correct part or refund its price. All details: Returns & warranty.

12. Warranty

Genuine parts carry the manufacturer’s warranty. If a part is defective, contact us with the order reference and photos: we check the case and handle the claim with the supplier or the manufacturer for you. Normal wear, incorrect installation, accidents, or use on a vehicle the part does not fit are not covered.

13. Liability

We are liable for orders that we place incorrectly and for damage caused by our fault. We are not liable for errors in the information you give us (for example a wrong vehicle or part number), for indirect losses such as lost earnings or vehicle downtime, or for installation work. Parts should be fitted by a qualified mechanic. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

14. Intellectual property and trademarks

The texts, design and structure of this website belong to Ximport Express LLC and may not be copied without our written permission. Ford, Lincoln and Mercury and the related names and logos are trademarks of Ford Motor Company; they are used only to identify the parts. This website is not affiliated with Ford Motor Company. Product images belong to their respective owners.

15. Force majeure

Neither party is liable for failing to perform its obligations because of events beyond its reasonable control that could not be foreseen (for example natural disasters, war, strikes, epidemics, or disruptions of transport and customs). If such an event lasts more than 15 days, either party may terminate the contract without damages, and any amount paid for parts not delivered is refunded.

16. Changes to these terms

We may update these terms. The version published on the website when you send your order request applies to that order.

17. Personal data

We process personal data in line with the EU General Data Protection Regulation (GDPR). See our Privacy policy.

18. Applicable law and disputes

These terms and the contracts concluded through this website are governed by the laws of the State of Delaware (USA), where Ximport Express LLC is registered. We try to settle every complaint amicably: write to [email protected] and we reply within 14 days. If no amicable solution is found, the dispute is settled by the competent courts. Nothing in these terms limits rights that cannot be excluded or limited under the law that applies to you.
